W uchwale rozstrzygnięto następujące kwestie: akt małżeństwa sporządzony w ramach zawieranego małżeństwa wyznaniowego (konkordatowego) ma charakter konstytutywny; przekroczenie 5-dniowego terminu, który ma charakter administracyjnoprawny, na złożenie zaświadczenia z art. 8 § 2 k.r.o. przez duchownego powinno skutkować odmową sporządzenia aktu małżeństwa – jeżeli jednak taki akt sporządzono, nie można uznać, że małżeństwo nie istnieje. W uchwale stwierdzono dodatkowo, że art. 10 Konkordatu nie nadaje się do bezpośredniego stosowania, a jedynie regulacje krajowe wydane na jego podstawie.The approving gloss presents the decision of the Polish Supreme Court of the court file III CZP 71/22, that is the resolution of seven justices taken on May 10, 2023. It shows that a marriage certificate prepared as part of a contractual marriage is of a constitutive nature, and exceeding the 5-day deadline, which is of an administrative nature, for submitting a certificate under art. 8 § 2 of the Family and Guardianship Code, by a clergyman, should, in principle, result in a refusal to prepare a marriage certificate. However, if such an act is prepared, it cannot be considered that the marriage does not exist.
