Abstrakt

Because of the role and importance of the Catholic Church in Polish history, clergy may be treated as a kind of custodian of collective tradition and national identity. Immediately after the Second World War radically changed the approach to the Catholic Church. Speeches against clergy was not accidental. Binding of a communist state ideology, stood in open conflict with religion and faith. Therefore in the years 1945-1956, a system that destroyed the basic to the enemy, the Catholic Church and its represetatives - the clergy. Criminal law in this case played a major hives. By taking this problem in this article I try to reflect its wider context. It addresses the assumptions and methods in their recruitment of a key force in the field of regulation and interpretation of the law.
