Pozycja Demokracja w państwie prawaJurek, Marek (Prymasowski Instytut Kultury Chrześcijańskiej im. Stefana Kard. Wyszyńskiego, 2008)This article presents the specific nature of democracy in a lawabiding state. Democracy is said to be the rule of the majority, while minority rights are respected. This definition is correct if rights are derived from claims. Democracy is also shaped by free elections and honest campaigning. Moreover a constitution, not necessarily codified as a written document, is an essential element of democracy as it defines the state’s basic principles and goals. Those basic regulations cannot be changed frequently and must remain superior towards other acts so that every citizen can benefit from them. In a democratic state authority must be subordinated to the law and opposition must have a free hand. Democracy is also a way to protect society against all forms of tyranny, but sometimes it cannot ensure the common good. The value of democracy stands or falls along with the values which it embodies and promotes. Authorities such as the Church and the Christian public play a significant role in guaranteeing the common good.
