Statut „De hiis autem” w rękopisie Archiwum Ziemi Morawskiej w Brnie
Krafl, Pavel (Uniwersytet Opolski. Redakcja Wydawnictw Wydziału Teologicznego, 2003)
Several medieval provincial statutes of the Gniezno church province were preserved in the form of undated remnants. One of these is the fragment De hiis autem. With its content, the statute relates to the regulations of both versions of the statute Cresente quottidie, which concerns crimes against clerics and prelates. It evidently originated as a reaction to the situation which arose in the Wrocław diocese. It is documented as an insert of archbishop John’s document of May 4th, 1381, which he issued at the prompting of the Wrocław chapter. The fragment was issued by one of John’s archbishop predecessors. A determination of the time is given by the issuing date of the so called Synodyk of archbishop Jarosław Skotnicki, which is not included in the statute (1357) and by the year that Jan IV ascended the archbishop cathedra (1373). It is still not known that the statute De hiis autem is also preserved in a medieval document of the Moravian Regional Archive in Brno, Gil , sign. 611. Among the transcriptions of documents of a silesian character we can find two notarial instruments which were to transume the text of the statute De hiis autem. The first notarial instrument is the commonly known and above-stated document issued at the prompting of the administrator and the Wroclaw chapter on May 4th, 1381 in Uniejów. However, the archbishop of Gniezno, Jan IV, already had the statute transumed at the prompting of the Wroclaw chapter on January 15th, 1381 (second notarial instrument). Publications of both notarial instruments can be found in the appendix, particularly the yet unreleased and unknown documents from January 1381 (Appendix No. 1) .
