Artykuł dotyczy pieczy zastępczej nad dzieckiem w kontekście realizacji praw i dobra dziecka. Wychowanie w rodzinie należy do podstawowych praw dziecka, natomiast umieszczenie dziecka poza rodziną w pieczy zastępczej może posiadać jedynie subsydiarny charakter. W artykule przedstawiona zostanie istota i uwarunkowania realizacji dobra dziecka, a także podjęta zostanie próba odpowiedzi na pytanie czy piecza zastępcza gwarantuje realizację praw i dobra dziecka.

The article concerns the foster care of a child in the context of the implementation of the rights and welfare of the child. Upbringing in a family is one of the basic rights of a child, while placing a child outside the family in foster care can only be of a subsidiary nature. The article will present the essence and conditions for the implementation of the child’s welfare, and an attempt will be made to answer the question whether foster care guarantees the realization of the rights and welfare of the child.
