dc.descriptionThe so-called exclaustration ad nutum Sanctae Sedis, in the Latin Church, gradually developed from the temporary secularization, i.e. in some serious instances a period of exclaustration was granted to a religious. Such a practice came to life around the XIX century. In fact, the Apostolic See began the practice of imposing exclaustration in the early 50’s of the previous century. The imposition of exclaustration on a perpetually professed was exercised by way of an indult requiring of him living temporarily out of community. The above procedure was part of a protective measure of the vita communis, and it often was a result of circumstances independent of the religious, such as establishing a new religious institute or as a result of the challenges and difficulties faced by the Western civilization, which had a significant impact on religious life in the 60’s of the previous century. The exclaustration ad nutum Sanctae Sedis was imposed in cases, in which there was a need for a perpetually professed to be formally expelled; due to the formal or material impediment, however, such a procedure could not be executed. The new Code of Canon Law of 1983 adopted such procedures and they were finally included in the Code.
