Abstrakt
Biskup Henryk z Wierzbna i biskup Jan Muskata mieli ze sobą ścisłe kontakty, choć nie wynikały one z powiązań rodzinnych, lecz ze wspólnych przekonań, szczególnie politycznych. Pierwszy proces dotyczył wyboru Jana na stolicę biskupią, został wytoczony przez arcybiskupa Jakuba Świnkę kilkanaście lat po wyborze, przewodniczącym sądu polubownego został Henryk z Wierzbna. Wyrok sądu był korzystny dla Muskaty, oskarżenia były zbyt powierzchowne. W 1306 r. arcybiskup Jakub Świnka wytoczył mu nowy proces, ze względu na jego niegodne zachowania. Kolejny konflikt Muskata miał z Łokietkiem, który zabrał biskupowi przywileje dane z rąk czeskich władców, co doprowadziło także do przejęcia rządów w diecezji przez Jakuba Świnkę, a Muskata udał się na wygnanie do Henryka z Wierzbna, do Wrocławia. Muskata odwołał się do papieża i do legata papieskiego. Odbył się kolejny proces na wyraźną prośbę Łokietka. Tym razem wyrok sądu uznał winę biskupa, który został ekskomunikowany i pozbawiony rządów. Henryk z Wierzbna okazywał mu dalej pomoc. Muskata został osadzony w więzieniu na Wawelu. Henryk składał apelację do papieża i legata. Muskata opuszczał więzienie, obiecując ugodę, ale na wolności, na Śląsku, ogłosił, że nie uznaje ugody, gdyż była zawarta pod przymusem. Zatrzymał się we Wrocławiu. Doprowadził do procesu z arcybiskupem przed legatem papieskim, a na procesie świadkiem był Henryk z Wierzbna. Zawarto umowę, tryumfował Muskata.
Bishop Henry from Wierzbno and Bishop Jan Muskata had close contacts with each other, although they did not result from family connections, but from common beliefs, especially political ones. The first trial pertained to the election of Jan to the episcopal capital, it was brought by Archbishop Jakub Świnka, several years after the election, and Henryk from Wierzbno became the chairman of the arbitration court. The court’s judgment was favorable to Muscat, the accusations were too superficial. In 1306, Archbishop Jakub Świnka brought a new trial against him, because of his unworthy behavior. Muskata had again another conflict with Łokietek, who took the bishop’s privileges given from Czech rulers, which also led to the takeover of the diocese by Jakub Świnka, and Muscat went into exile to Henryk from Wierzbno, to Wrocław. Muskata appealed to the Pope and to the Pope’s legate. Another process took place at the explicit request of Łokietek. This time, the court’s judgment recognized the fault of the bishop, who was excommunicated and deprived of his rule. Henry from Wierzbno provides help again. Muskata is imprisoned in Wawel. Henry makes appeals to the Pope and legate. Muskata leaves prison, promises a settlement, but at liberty, in Silesia, he announces that he does not accept the settlement, because it was under coercion. He stays in Wroclaw. He leads to the trial with the archbishop before the Papal legate, and the witness at that trial was Henryk from Wierzbno. A contract was made, Muskat triumphed.
