Ocena przepisów prawnych i współpracy duchownych z kierownikami USC po 11 latach od wejścia w życie Konkordatu między Stolicą Apostolską i Rzecząpospolitą Polską

Abstract

The article consists of an introduction forming a short historical scheme, three main parts and a summary. The first part constitutes an attempt to evaluate valid legal regulations, especially those concerning the accusations against the art. 10 of the Concordat before its ratification and the accusations against the accordance of valid acts with the art. 10 of the Concordat. In the second part, the way of valid implementation is presented, focusing on three basic phases: the celebration preceding the contraction of marriage, the contraction of marriage itself and the following phase. The conclusion of this part presents the difficulties concerning law implementation on the part of the clergyman. The third part evaluates the cooperation between priests and Civil Registry (USC) directors and presents the extent of reciprocal relations, the ways of cooperation and its results. The article ends with a summary, in which the attention is drawn to certain reservations about the regulations introduced by the Concordat and included in the Polish law, in particular the Church law, and also the reservations about the interpretation and application of those regulations. In conclusion, it is observed that one can safely consider the cooperation between priests and USC directors fruitful and serving greater good for the people concerned.
