Dziecko jako świadek w procesie karnym

Abstract

Niniejsza publikacja jest poświęcona problematyce dzieci występujących w procesie karnym w charakterze świadka. Skupia się ona przede wszystkim na wskazaniu funkcji ochronnej norm prawnych zarówno krajowych jak i międzynarodowych. Artykuł przedstawia procedurę obowiązującą przy przesłuchiwaniu dziecka jako świadka. Autorzy swoją uwagę skupili na określeniu zakresu przedmiotowego oraz na określeniu forum uczestników takiego przesłuchania, a także wskazaniu ich praw i obowiązków. W publikacji dokonano oceny regulacji polskich na tle uregulowań międzynarodowych. Sformułowane zostały także postulaty de lege ferenda w zakresie regulacji prawnych odnoszących się do dzieci występujących w procesie karnym w charakterze świadków.

The article concerns the procedure of examining a child as a witness in the Polish lawsuit. The scope of the research does not allow its authors to show the complete description of the issue. Therefore, they focused, in their opinion, on the most important issue, which is dealing with the child’s examination. The article classifies child witnesses according to regulations of criminal procedure. It also focuses on attendance of the psychologist and legal representative during the examination. Authors pointed at the rights and duties that weight on the authorities responsible for examination. The analysis of the regulatory framework is aimed at showing their protective function and it was based on the theoretical and practical law applications, as well as on the acts of international law.
