„Doktryna odkrycia” w świetle trzech papieskich bulli

Połączone Dykasteria Kultury i Edukacji oraz Dykasteria ds. Integralnego Rozwoju Człowieka we wspólnym oświadczeniu stwierdziły, że tak zwana „doktryna odkrycia”, rozumiana jako zasada, że fakt odkrycia nowych lądów daje prawo do ich posiadania, nigdy nie była częścią nauczania Kościoła. Autorzy noty przypomnieli, że zdaniem niektórych uczonych podstawy wspomnianej doktryny odnaleźć można w bullach Dum diversas, Romanus pontifex i Inter cetera, stwierdzając jednocześnie, że dokumenty te powstały jednak w konkretnym okresie historycznym i były powiązane z kwestiami politycznymi, a ich treść została zmanipulowana do celów politycznych przez konkurujące ze sobą mocarstwa kolonialne. Artykuł przybliża treść dwóch dokumentów (Dum diversas, Romanus pontifex i Inter cetera), opisując kontekst historyczny, w którym powstały. Dokumenty, choć zawierają oddanie nowo odkrytych lądów pod panowanie odpowiednio Portugalii i Hiszpanii, nie odnoszą się wprost do „zasady”, czy „doktryny”, nie definiują jej i nie uzasadniają. Nie ma również przesłanek, by stwierdzić, że zasada prawna Stanów Zjednoczonych odwołująca się do „doktryny odkrycia” wynika z nauczania Kościoła. Ważnym dokumentem, ilustrującym rozwój katolickiej idei dotyczącej praw narodów do samostanowienia, jest bulla Pawła III Sublimis Deus, która ze względu na zakres teologicznych uzasadnień i sposób, w jaki papież podaje poszczególne prawdy, może być uznana jako nauczanie Kościoła.

Joined Dicasteries for Culture and Education and for Promoting Integral Human Development in a joint statement pronounced that so-called “discovery doctrine”, understood as a rule that the fact of discovering new territories gives the right to possess them, was never a part of the teaching of the Church. The authors of the note reminded that in opinion of some scientists the fundamentals of above-mentioned doctrine can be found in the bulls: Dum Diversas, Romanus Pontifex and Inter Cetera, and stated at the same time that these documents had come into existence in a specific historical period and were interrelated with political aspects and their content was manipulated for political reasons by colonial powers. The paper approximates the content of two documents (Dum Diversas, Romanus Pontifex and Inter Cetera) describing a historical background in which they were created. These documents, although they contain giving away newly discovered territories under the rule respectively of Portugal and Spain, do not intend to apply directly to a rule or a doctrine and they do not define or justify it. There are not any indications to assume that the law principle of the United States relating to “discovery doctrine” arises from the teaching of the Church. An important document that illustrates development of a catholic idea concerning nations’ right to self-determination is a bull of Paul III Sublimis Deus, which on the account of a range of theological issues and the way the pope passes individual truths, may be recognized as the teaching of the Church.
