Uwagi o prawach dziecka

Abstract

W artykule wskazuje się m.in. na tendencję charakterystyczną dla współczesnych badań nad prawami człowieka i prawami dziecka, a mianowicie przesunięcia tej problematyki na teren prawa stanowionego, a odchodzenia od uzasadnień prawnonaturalnych i antropologiczno-filozoficznych. Przesunięcie to sprawia, że może ulec zapoznaniu normatywny charakter natury ludzkiej, jak i konieczność prowadzenia dalszych dociekań w tym zakresie na rzecz podkreślania wagi negocjacji i konwencji w ustalaniu reguł chroniących poszczególne dobra osoby ludzkiej. Ukazanie praw dziecka w kontekście współczesnego paradygmatu praw człowieka, a następnie analiza materialnych i formalnych przesłanek praw dziecka, a także obraz dziecka jako podmiotu praw w Konwencji o Prawach Dziecka i jego zbieżność z podstawowymi danymi antropologii filozoficznej - pozwalają ukazać operatywny sens kategorii natury ludzkiej w odczytywaniu ludzkich uprawnień i ukazywaniu egzystencjalnego statusu człowieka na wczesnych etapach rozwoju. W artykule również znalazły się uwagi o wybranych problemach w ujmowaniu i realizacji praw dziecka. W podsumowaniu wskazuje się na możliwość przezwyciężenia opozycji i pogodzenia obu podejść w zakresie wyjaśniania i uzasadniania praw dziecka w celu ich integralnego ujęcia.

The paper indicates, among others, on the tendency characteristic for contemporary research on human rights and the rights of the child, namely the transfer of this problem to the area of positive law, and the leaving from legal-natural and anthropologicalphilosophical justifications. This displacement causes possibility of forgetting the normative character of human nature, as well as the necessity to conduct further inquiries in this regard, in order to emphasize the importance of negotiations and conventions in establishing the rules protecting individual goods of the human person. Presentation of the rights of the child in the context of the contemporary human rights paradigm, the analysis of material and formal premises for the children’s rights, the image of the child as a subject of rights in the Convention of the Rights of the Child and its accordance with the basic data of philosophical anthropology ‒ let us show the operative sense of the category of human nature in reading human rights and showing existential status in the early stages of human development. The article also includes remarks on selected problems in the interpretation and implementation of the protection of children’s rights. At the end is mentioned possibility of overcoming the opposition and reconciling both approaches in explanation and justification of the rights of the child for their integral recognition.
