Niektóre problemy prawne związane z zawieraniem małżeństw przez katolików z prawosławnymi

Abstract

The marriages of Catholics with Orthodoxes as the mixed marriages, must conform to the rules of the Catholic Church which were particularly issued for this kind of marriages. Hitherto existing rules of the Canonic Law Code have been considerably soften lately by the following dispositions: a) the lnstruction of the Faith Doctrine Congregation „Matrimonii sacramentum” of 18 III 1966, b) Decree of the Congregation for Oriental Churches „Cresicens matrimoniorum mixtorum” of 22 II 1967 and c) M.P. of Paul VI „Matrimonia mixta” of 31 III 1970. That will undoubtedly contribute to more frequent contractions of the marriages between Catholics and Orthodoxes in our country. The author of this article deliberates and tries to discuss the following problems: a) Whether the persons who were brought in the Orthodox environment which acknowledges divorces thereby at the contraction of the marriages with Catholics don't exclude the essential attribute of the christian marriage-its indissolubility. b) How is to be estimated on the forum of the Catholic Church the legal status of the divorced persons in the Orthodox Church. c) What requirements are to a reasonable contraction of marriage by Catholics in Orthodox Church and what duties lie on the Catholic Priest in relation to the members of Catholic Church who are contracting mixed marriages with Orthodoxes.
