Nepotyzm a zaufanie społeczeństwa do instytucji państwa

Abstract

The aim of this study is an attempt to assess the impact of the phenomenon of nepotism on public confidence in the state institutions. The starting point is the analysis of the theory of natural selection and total adjustment. Next, the right to access to the public service was discussed. The third part presents the concept and the essence of the phenomenon of nepotism. Further considerations regarding the principle of objectivity in public administration and the principles of openness of recruitment resulting from other acts, including from the act on local government employees.

Celem niniejszego opracowania jest analiza wpływu zjawiska nepotyzmu na zaufanie społeczeństwa do instytucji państwa w świetle przepisów prawa, orzecznictwa sądowego oraz praktycznego działania prawa. Punktem wyjścia jest omówienie prawa dostępu do służby publicznej. Następnie przedstawione zostało pojęcie i istota zjawiska nepotyzmu. Kolejne rozważania dotyczą zasady obiektywizmu w administracji publicznej oraz zasady jawności naboru wynikające z innych ustaw m.in. z ustawy o pracownikach samorządowych.
